Price corrections apply to future orders only and do not affect confirmed, paid orders.

Certain promotions or offers may be subject to limitations including limited stock, time restrictions, single-use per customer, or regional eligibility, which will be communicated at the time of the offer.

Order Acceptance and Cancellation

Placing an order constitutes an offer by you to purchase the selected product(s) at the stated price. We reserve the right to accept, partially accept, or reject any order for any reason, including stock unavailability, suspected fraud, or pricing errors.

If we reject or cancel your order, we will notify you promptly and issue a full refund of any amounts already paid.

Payment

Payment must be made via the methods available at checkout, including credit and debit cards, net banking, UPI, and digital wallets. By placing an order, you authorise us to charge your selected payment method for the total amount due.

We use a third-party payment gateway to process transactions. The security measures for payment processing are the sole responsibility of that third-party provider. We are not responsible for any loss or damage arising from payment gateway failures, unauthorised transactions, or charges imposed by your bank or payment provider.

All transactions must be completed in Indian Rupees. We do not facilitate transactions in any other currency.

Shipment, Delivery and Risk

Delivery estimates provided at checkout are indicative only and may vary due to courier schedules, public holidays, or factors beyond our control. We are not liable for delays caused by third-party courier partners.

Risk of loss or damage passes to you once the package has been successfully delivered to your provided address and accepted. If your order arrives with visibly damaged or tampered packaging, please refuse the delivery and contact us immediately at [insert support email or WhatsApp]. For damage discovered after accepting delivery, notify us within 24 hours with photographs. We will investigate and arrange a replacement or refund as applicable.

If delivery fails due to an incorrect address provided by you, repeated missed delivery attempts, or refusal to accept the package, the order may be returned to us. Re-delivery charges will apply for further attempts. Please refer to our Shipping Policy for full details.

Returns, Refunds and Cancellations

Returns, refunds, and cancellations are governed by our Cancellations and Refunds Policy.

Electronic Communication

User-Generated Content

If the site allows you to post reviews, comments, questions, or other content (“User Content”), you are solely responsible for the accuracy and legality of that content. You represent that you own or have the rights to all content you post, and that it does not infringe any third-party rights.

By posting User Content, you grant Intimate Tribe a perpetual, non-exclusive, royalty-free, worldwide license to use, reproduce, publish, and distribute that content across our platforms and marketing channels.

We do not endorse any User Content and reserve the right to remove any content that violates these Terms or applicable law.

Disclaimers and Limitation of Liability

The site and its content are provided on an “as is” and “as available” basis without warranties of any kind, except as required by applicable law.

To the fullest extent permitted under Indian law, Intimate Tribe’s total liability to you for any claim arising from these Terms or your use of the site shall not exceed the value of the specific order giving rise to the claim.

We are not liable for indirect, incidental, special, or consequential damages including loss of data, revenue, or profits, arising from your use of or inability to use the site or our products. Nothing in these Terms limits our liability for death, personal injury, or fraud caused by our negligence.

We are not responsible for any loss in functionality arising from internet connectivity issues, device failure, or disruptions caused by your service provider.

Indemnification

You agree to defend, indemnify, and hold harmless Intimate Tribe and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of or access to the site, products, or information
• Your violation of these Terms or any applicable law
• Your violation of any third-party right including intellectual property or privacy rights
• Any unauthorised or unlawful use of your account by any person, whether or not authorised by you

Termination

We reserve the right to suspend or terminate your access to the site at any time, with or without prior notice, if you breach these Terms or engage in conduct we reasonably consider harmful, unlawful, or damaging to the site, other users, or our brand.

Upon termination, you must stop using the site and destroy any downloaded or copied content from it.

The following provisions survive termination: Disclaimers and Limitation of Liability, Intellectual Property, Indemnification, Grievance Officer, Governing Law and Dispute Resolution, and General Provisions.

Force Majeure

We shall not be held liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, acts of God, pandemics, epidemics, government actions, civil unrest, strikes, power failures, internet outages, or courier disruptions. We will make reasonable efforts to resume normal operations as soon as possible.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of India.

Any dispute arising out of or in connection with these Terms, the site, or our products shall first be attempted to be resolved amicably within 30 days of written notice by either party.

If a resolution is not reached, the dispute shall be referred to and finally resolved by a sole arbitrator, appointed jointly by both parties, in accordance with the Arbitration and Conciliation Act, 1996, as amended. The seat and venue of arbitration shall be Chennai, Tamil Nadu. The language of proceedings shall be English. Each party shall bear its own costs unless otherwise directed in the award.

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, we have designated a Grievance Officer to address complaints and concerns:

We will acknowledge all grievances within 24 hours and resolve them within 15 days of receipt. Where a grievance relates to content that violates applicable law, we will act on it in an expedited manner in accordance with applicable timelines.

General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, Shipping Policy, and Cancellations and Refunds Policy, constitute the entire agreement between you and Intimate Tribe regarding your use of the site and supersede all prior communications or agreements between us.

Amendments: We may update these Terms at any time. Changes are effective immediately upon posting. Your continued use of the site after any change constitutes acceptance.

Assignment: You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations at our sole discretion without restriction.

Waiver: Our failure to enforce any right or provision of these Terms at any time shall not constitute a waiver of that right or provision. No single or partial exercise of any right prevents further exercise of that right.

Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Electronic Validity: Your acceptance of these Terms through electronic means constitutes a valid, binding, and enforceable agreement under the Information Technology Act, 2000 and the Indian Contract Act, 1872.
